Equine liability concerns the legal responsibility arising from horse-related activities, injuries, property damage, or business operations, which can often be reduced or better managed through carefully drafted contracts, liability waivers, releases, and other legal documents.

Equine litigation encompasses a wide range of legal matters, including breach of contract disputes, fraud and misrepresentation claims, veterinary malpractice actions, violations of the Michigan Consumer Protection Act, ownership and possession disputes, conversion and civil theft claims, boarding and training disputes, equine injury and liability claims, and other horse-related business and transactional conflicts.

Horse sale and lease disputes involve conflicts arising between parties in connection with the purchase, sale, or lease of a horse. These disputes may occur at various stages of the transaction and often involve issues such as misrepresentation, nondisclosure, breach of contract, ownership rights, health or soundness concerns, performance expectations, or payment obligations. Many disputes can be resolved through negotiation or pre-litigation resolution efforts before formal legal action becomes necessary.
Effective resolution of horse sale and lease disputes requires a comprehensive understanding of the Uniform Commercial Code, which governs commercial transactions in the United States, including certain sales and lease transactions involving horses, together with applicable state law and industry customs and practices.

The goal is to negotiate and prepare customized contracts designed to clearly reflect the client’s intentions while anticipating and addressing potential issues or disputes that may arise during the contractual relationship. Thoughtful and carefully tailored contract drafting is intended to minimize risk, reduce misunderstandings, and help avoid future litigation. Services include the preparation and review of boarding agreements, training contracts, purchase and sale agreements, lease agreements, liability waivers and releases, breeding contracts, commission agreements, and other equine-related business and transactional documents.

Equine-related real estate transactions involve the legal processes, negotiations, and documentation associated with the purchase, sale, lease, and development of horse properties and equine facilities. These transactions require careful attention to both traditional real estate concerns and the unique issues associated with horse ownership, boarding, training, breeding, and equestrian operations.
Representation may include the drafting and review of purchase agreements, leases, land contracts, boarding and facility-use provisions, easements, liability and indemnification provisions, zoning and land-use matters, agricultural and commercial use issues, boarding stable operations, and title and property review. Particular attention is given to matters affecting barns, arenas, pastures, fencing, access rights, manure management, equine business operations, and compliance with applicable local and state regulations.
Carefully structured documentation and due diligence help protect clients’ interests, minimize liability exposure, and ensure that the property and transaction properly support the client’s intended equine use and business objectives.

With respect to any horse-related dispute, mediation is the least expensive and most effective way in which to resolve conflicts and avoid litigation. The process is fairly informal and generally takes less than a day and can lead to a win-win resolution for all parties to the dispute.

Michigan Equine Law was founded and is managed by Lisa Pinkos Howle, who has litigated equine-related claims on behalf of plaintiffs and defendants throughout Michigan and nationally for more than 25 years, with a focus on cost-effective representation and successful outcomes.
Lisa is actively involved in the equestrian community, competing with her own horses and qualifying for the United States Dressage Federation Region 2 Finals in multiple years. Her firsthand experience managing both horses and a horse farm provides practical insight that enhances her ability to effectively and knowledgeably address clients’ equine legal needs.
Lisa represents clients across a variety of equestrian disciplines in Michigan and Idaho courts and has handled litigation, dispute resolution, and transactional matters for clients in Michigan, Kentucky, Illinois, Idaho, and Ohio.
Her practice includes representation of horse owners, buyers, sellers, trainers, equine professionals, lessees and lessors, breeders, farriers, boarding stables, and equine businesses, as well as American Kennel Club dog owners, breeders, and animal rescues in animal-related legal matters.
Lisa also drafts and reviews equine purchase and sale agreements, leases, liability waivers and releases, boarding contracts, and related business documentation. In addition, she assists clients with the formation of limited liability companies and nonprofit corporations, contract review and negotiation, and equine-related real estate transactions.
A significant portion of her practice focuses on equine litigation, including horse sale and lease disputes involving fraud, misrepresentation, nondisclosure, and contract-related claims.
